1. Acceptance of Terms

By accessing or using the website skyedragongifts.com ("the Site") or placing an order with SkyeDragon Gifts ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site. We reserve the right to update these Terms at any time; continued use of the Site after any changes constitutes your acceptance of the revised Terms.

2. Use of the Website

Permitted use: You may use the Site for lawful personal, non-commercial purposes to browse products and place orders.

Prohibited conduct: You agree not to:

• Use the Site for any fraudulent or unlawful purpose
• Attempt to gain unauthorized access to any part of the Site, server, or database
• Transmit viruses, malware, or any other malicious code

3. Products and Pricing

We reserve the right to modify product descriptions, pricing, and availability at any time without notice. Prices are displayed in US Dollars unless otherwise noted. We make every effort to display accurate product images and descriptions; however, we do not warrant that product descriptions, colors, or specifications are error-free. In the event of a pricing error, we reserve the right to cancel any orders placed at an incorrect price and notify the affected customer promptly. We also reserve the right to limit the quantity of any item purchased per person, per household, or per order.

4. Order Acceptance and Cancellation

Placing an order constitutes an offer to purchase, not a binding contract. We reserve the right to accept or refuse any order at our discretion, including but not limited to cases of suspected fraud, product unavailability, or pricing errors. You will receive an order confirmation email upon successful placement. If we cancel your order, you will receive a full refund. Once an order has been submitted, cancellation requests must be made immediately by contacting support@skyedragongifts.com. We cannot guarantee cancellation after fulfillment has begun.

5. Payment and Billing

We accept major credit cards, PayPal, Apple Pay, Google Pay, and other payment methods displayed at checkout. By submitting payment, you represent that you are authorized to use the payment method provided. All transactions are processed through secure, PCI-DSS-compliant payment processors. Charges will appear on your statement as "SkyeDragon Gifts" or the name of our payment processor. We are not responsible for additional fees charged by your bank or financial institution.

6. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, product descriptions, and the overall look and feel of the Site — is the property of SkyeDragon Gifts or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

7. User-Generated Content

By submitting reviews, comments, or other content to the Site, you grant SkyeDragon Gifts a non-exclusive, royalty-free, perpetual license to use, display, reproduce, and distribute that content in connection with our business and marketing. You represent that you own or have the right to submit the content and that it does not violate the rights of any third party. We reserve the right to remove any user-generated content that we determine, in our sole discretion, to be inappropriate, false, or in violation of these Terms.

We have no control over their content, privacy practices, or terms, and we are not responsible for any damages or losses arising from your use of third-party sites.

9. Disclaimer of Warranties

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, SkyeDragon Gifts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, arising out of or in connection with your use of the Site or purchase of products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from your use of the Site or purchase of products shall not exceed the amount you paid for the applicable order.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to conflict of law principles. In the event of a dispute, we encourage you to contact us first at legal@skyedragongifts.com so that we can attempt to resolve the matter informally. If informal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Newaygo County, Michigan. Nothing in this clause prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.

12. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Site following any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
